K1 Visa the Positive Side and the Negative? K1 Visa Positive:
There are many positive sides to the K1 Visa. The K1 Visa holder will be able to work after getting a social security card and the EAD (Employment Authorization Document). The afore mentioned documents is applied for when you apply for the Adjustment of Status. This takes place after marriage however. It takes up to 90 days to receive the EAD. As the K1 Visa is good for 90 days, the K1 Visa give both parties ample time to plan their wedding before the K1 Visa expires.
K1 Visa Negative:
There are negative sides to the K1 Visa. Firstly the K1 Visa holder must apply for advance parole when traveling outside of the United States. The K1 Visa holder also has to file for an adjustment of Status once in the United States. Should the marriage not occur the K1 Visa holder would have to leave the US before the 90 days. The K1 Visa is cannot be extended as it is a once off visa. i.e Once it has been used, it cannot be reused.
